PIAC made a short submission to the Alice Springs Town Council (the Council) in response to its proposed by-laws for the management of public places in the Alice Springs municipality. PIAC’s submission focuses on a particular by-law which places significant restrictions on the right to freedom of political communication implied in the Commonwealth Constitution. The submission argues that the proposed by-law may be unconstitutional and/or ultra vires as it unreasonably infringes on the right to freedom of speech. PIAC encourages the Council to revise its proposed by-law in order to ensure that it does not infringe on this civil liberty.
