False imprisonment case gets hearing date

PIAC’s long-running false imprisonment test
case against the State of New South Wales has been set down for hearing between
23 August and 31 August 2010. 

 

PIAC’s client alleges the Department of
Community Services unlawfully detained her for over six years at the Kanangra
Centre on the mid-north coast of NSW.  The woman has a mild to
moderate intellectual disability and had lived in the community before her
detention until she was eighteen.  

Kanangra, near Morisset, was slated for closure
after a Government inquiry in the 1980s.  The case asserts the right
of people with disability not to be held in institutional settings of any sort without
proper orders for detention.
