In 2010, the Department of Fair Trading called for submissions on the Draft Residential Tenancies Regulation 2010 (The Regulation). PIAC’s submission to this process particularly responded to clauses relating to water efficiency measures and rights and obligations of landlords and tenants. In a call for greater water efficiency and affordability for tenants, PIAC advocated for changes to The Regulation to encourage landlords to retrofit rental properties with dual flush toilets, a move that could save 25,000 litres of water per replacement per year. An understanding that tenants are being charged a gas supply fee, even where the tenant is not using gas at all, led PIAC to call for tenants to be free of obligations to pay gas supply charges unless the tenant is drawing gas through the meter.
