PIAC’s submission to this Review by the NSW Ombudsman:(a) responds to the Ombudsman’s Issues Paper on this Review (insert hyperlink to the Issues Paper).(b) makes extensive reference to its earlier “Submission to NSW Parliamentarians on the Terrorism (Police powers Amendment (Preventative Detention) Bill 2005 (2005) (insert hyperlink to this submission). In addition, it points out that the operation of the Terrorism (Police Powers) Act 2002 (NSW) (‘the Act’), and legislative amendments designed to facilitate its implementation, further breach the human rights of children and adults detained under the Act by:(a) detaining children in adult correctional centres(b) not providing separate detention facilities for persons detained under the Act(c) not according procedural fairness to respondents to applications for preventative detention orders under the Act(d) not making adequate provision for the protection of the human rights of persons detained pursuant to the Act.
